All our Products made by us are subject to the following Terms and Conditions.

INGREDIENTS

All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens.

It is the responsibility of the Customer to inform me prior to the confirmation of their booking of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly the Supplier will not be held liable for any allergic reaction resulting from consumption of the cake.

All products are made to be eaten on the day of the celebration.

ORDERS

We prefer at least fourteen (7) days’ notice for all orders, as we are continually booked in advance. We will however endeavour, where availability permits accept short notice cakes.

Any Products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.

 DEPOSITS

A non-refundable deposit of 50% is required to hold your date within three (3) days prior to pick up.

Where we have delivered what is quoted and invoiced, but the Customer does not accept the finished Product, the deposit WILL NOT be refunded. The Customer can choose to pay the remainder and take the Product/s or leave them at no extra cost.

UNFORESEEN CIRCUMSTANCES

Where we cancel the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the Customer.

FINAL BALANCE PAYMENTS AND PICKUPS

The balance of the invoice is due on the date listed on the invoice. Any payment not made prior to this date may result in cancellation on your order.

It is the responsibility of the Customer to check the state of the product before leaving the premises. Once the item has left the premises, the Customer is responsible to ensure that product arrives to its destination safely and is stored as per our instructions to achieve best results for taste and quality.

 DELIVERY

We offer delivery for certain local destinations.

Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, we are not liable for any damages.

A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back with our premises, and it will be the customer’s responsibility to collect the product. Delivery fee’s will not be refunded.

PUBLICATION

We reserve the right to use any image of a Product made by us for publication at a later date.

PICKUP

The Customer is liable for any damage, accident, or mishap that may occur once the cake is released from the care and custody of the Supplier’s. The Supplier is not liable for any damage that may occur thereafter.

POSTPONEMENT

If, for any reason the event is required to be postponed, please contact me immediately.

The new date proposed will be subject to availability.

CANCELLATIONS/REFUNDS

If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:

If the cancellation is up to seven (7) days in advance of your event date, you will receive a full refund, less the cost of any supplies already purchased for your cake.

If the cancellation is less than three (3) days prior to your event, there will be absolutely no refunds given.

Refunds will be paid within 30 days of cancellation.

Privacy Policy

1)    This privacy policy applies to the baker bee’s website at www.thebakerbee.com.au (the “Website”). We at the the baker bee take your privacy seriously. This policy covers the collection, processing and other use of personal data under the Data Protection Act 1998 (“DPA”) and the General Data Protection Regulations (“GDPR”).

2)    For the purpose of the DPA and GDPR we are the data controller and any enquiry regarding the collection or processing of your data should be addressed to

Information we collect

4)    We will collect personal data on this Website only if it is directly provided to us by you the user, e.g. your e-mail address, name, home or work address, and telephone number, and therefore has been provided by you with your consent. Normally you will only provide such details if you wish to sign up for our free e-newsletter or other resources, or are making a purchase from us.

5)    We also use analytical and statistical tools that monitor details of your visits to our website and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data (but this data will not identify you personally).

6)    Your payment information (e.g. credit card details) provided when you make a purchase from our website is not received or stored by us. That information is processed securely and privately by the third party payment processors that we use. The baker bee will not have access to that information at any time. We may share your personal data with our payment processors, but only for the purpose of completing the relevant payment transaction. Such payment processors are banned from using your personal data, except to provide these necessary payment services to us, and they are required to maintain the confidentiality of your personal data and payment information.

Use of your information

 7)    We may hold and process personal data that you provide to us in accordance with the DPA and GDPR.

8)    The information that we collect and store relating to you is primarily used to enable us to provide our services to you, and to meet our contractual commitments to you. In addition, we may use the information for the following purposes:

8.1   To notify you about any changes to our website, such as improvements or service/product changes, that may affect our service;

8.2   If you are an existing customer, we may contact you with information about goods and services similar to those that were the subject of a previous sale to you;

8.3   Where you have consented to receive our e-newsletters, from time to time to provide that to you.

8.4   All photos sent to any of our shops are only held for the duration of the order and are deleted straight after to comply with GDPR.

Disclosure of your information

9)    We may disclose your information to regulatory bodies to enable us to comply with the law and to assist fraud protection and minimise credit risk.

10) Please be advised that we do not reveal information about identifiable individuals to our advertisers but we may, on occasion, provide them with aggregate statistical information about our visitors.

11) If you have given us consent to use your data for a particular purpose you can revoke or vary that consent at any time. 13) We may disclose your personal data outside of our group: (a) in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets; and (b) if the the baker bee business is bought by a third party, in which case personal data held by it about its customers will be one of the assets to transfer to the buyer.  However, any such transfer will only be on terms that the confidentiality of your personal data is protected and that the terms of this privacy policy will continue to be complied with by the recipient.

14) Otherwise, we will process, disclose or share your personal data only if required to do so by law or in the good faith belief that such action is necessary to comply with legal requirements or legal process served on us or the website.
